Terms of Service for SprachXP

These Terms of Service govern your use of the SprachXP mobile application, website, and related online services. By using SprachXP, you agree to these terms. If you do not agree, please do not use the service.

1. The Service

SprachXP provides tools for learning German vocabulary and grammar, including training exercises, audio, progress tracking, achievements, profiles, and leaderboards. Features may change as the service develops.

4. Your Profile and Content

You retain responsibility for profile names, avatars, diagnostic reports, and other content you submit. You grant SprachXP a limited permission to store, process, and display that content only as needed to operate the service, including public profile and leaderboard features you choose to use.

We may remove content or restrict accounts when reasonably necessary to protect users, comply with law, or enforce these terms.

5. Learning Content

SprachXP is an educational aid. We work to keep vocabulary, translations, examples, grammar materials, audio, and progress calculations accurate, but errors may occur. The service is not a substitute for professional educational, legal, medical, or other specialist advice.

6. Purchases, Subscriptions, and Advertising

SprachXP may offer paid features, subscriptions, or advertising. Purchases made through an app store are also governed by that store's terms, billing rules, and refund procedures. Prices and included features will be shown before purchase. Unless required by applicable law or the relevant app store rules, payments are non-refundable after the applicable service has been provided.

7. Privacy

Our collection and use of personal information is described in the SprachXP Privacy Policy. Instructions for requesting account and data deletion are available on the Account and Data Deletion page.

8. Intellectual Property

The SprachXP application, branding, software, design, databases, and original content are protected by applicable intellectual property laws. These terms give you a personal, limited, non-exclusive, non-transferable, and revocable right to use the service. They do not transfer ownership of SprachXP or third-party content.

9. Third-Party Services

SprachXP relies on third-party services such as Google Firebase, Google Sign-In, app stores, analytics, advertising, hosting, and payment providers. Their own terms and privacy policies may apply. We are not responsible for third-party services outside our control.

10. Availability and Changes

We may update, suspend, or discontinue features for maintenance, security, technical, legal, or business reasons. We do not guarantee that every feature will always be available, error-free, or compatible with every device.

11. Suspension and Termination

You may stop using SprachXP at any time and may request account deletion. We may suspend or terminate access when reasonably necessary because of a serious or repeated violation of these terms, security risk, abuse, legal requirement, or risk of harm to the service or other users.

12. Disclaimers

To the extent permitted by applicable law, SprachXP is provided on an "as is" and "as available" basis without warranties that the service will be uninterrupted, completely accurate, or free from defects. Nothing in these terms excludes rights or warranties that cannot legally be excluded.

13. Limitation of Liability

To the extent permitted by applicable law, SprachXP will not be liable for indirect, incidental, special, consequential, or punitive losses, or for loss of data, progress, revenue, or opportunity resulting from use of or inability to use the service. This limitation does not apply where liability cannot legally be limited or excluded.

14. Changes to These Terms

We may update these terms when the service, legal requirements, or business practices change. The updated version will be posted on this page with a revised "Last updated" date. Continued use after an update means you accept the revised terms where permitted by law.
